On December 1, 2015 (ACHP), we are writing to you regarding the possible violation of several laws regarding the demolition and destruction of the King's House in the town of Cidra, Puerto Rico. This letter was answered on August 18, 2015, and sent to the Honorable Javier Carrasquillo, who at that time was the Major, City of Cidra, Puerto Rico. The letter is signed by Charlene Dwin Vaughn (Assistance Director: Office of Federal Agency Programs Federal, Permiting, Licensing and Assistance Section). Its purpose was to warn and stop the demolition and destruction of the bi-centennial historical legacy of the King's House. The historic property (King's House = 'irreplace heritage'), is being altered and its preservation would be essential for the education of future generations. [300308-Historic property] Essential historical monument in the foundation of Cidra, Puerto Rico. None of the Mayors, from Mr. Carrasquillo onwards, have informed us of the projects in place. [The letter indicates this] Comprehensive state planning for historic preservation (OECH), does not reach Cidra. There is no single verifiable project of their help. It is their legal and ministerial responsibility to act in defence of Our Heritage and to plan verifiable aids, identification and registration of the property=King's House, and careful treatment of historic properties. [300315-Preservation or historic preservation] I am sorry to say, the aid from both OECH and ACHP never reaches Cidra. Today, unfortunately, we turn to you again to request that you immediately investigate and remedy what is happening in the place currently. Windows, floors, walls are being broken and large holes are being made in the walls of the building. The possible violation of the historical properties of Cidra, is once again at stake and in a delicate way. [36 CFR Part 800] The National Register of Historic Places (RNLH) has been ignored and affected by municipal authorities and the National Historic Preservation Act of 1966, which has been completely violated. [ 3002107. Regulations (1)] ''Therefore, the city should review this project to determine if Federal Funds or approvals will be required, therby, trigering compliance with Section 106.''. We understand that there is the possibility that multiple legal provisions, both insular and national, are being violated irresponsibly, and knowing that compliance failures exist with the Law: Section 106 (NHPA) (54 U.S.C. 306108). The King's House[Casa del Rey], meets all the requirements to be included in the National Register of Historic Places as it meets all the eligibility requirements. There is also a possible violation of Section 110(K) of NHPA. ''... Prohibits and applicant for federal assistance from significant adversely affecting historic properties with the intent to avoid a Section 106 review.'' In addition, Assistance Director Charlene Dwin Vaughn (Assistance Director: Office of Federal Agency Programs Federal, Permiting, Licensing and Assistance Section), clearly indicates the following: '' In closing we request that the city investigate this matter and inform Mr. Cabello and the ACHP wheter or not Section 106 applies to this project.'' (Letter of August, 18, 2015) It should be noted that the Puerto Rico office of the State Office of Historic Preservation has not done anything in favor of the protection of the 'Casa del Rey'= King's House of Cidra, and at the same time nothing is known about its actions to preserve the King's House[Casa del Rey]. It is a significant property for Puerto Rico, with more than two centuries of history since the founding of our town. What's more, the property is denied by the Municipal authorities to be included in the National Register of Historic Places (RNLH), you will know the reasons. We do not know them. Unfortunately, they have not done their job of taking care of our heritage. Cidra, lacks a program overseen by the National Registry of Historic Places. Nothing is preserved and even less is preserved; we urgently need your attention to scientifically stabilize, rehabilitate, restore and rebuild our King's House=Casa del Rey- Antigua Alcaldía.
